These Terms of Service ("Terms") govern your access to and use of the Foxhole Analytics platform, including all associated features, content, signals, forecasts, and data services (collectively, the "Service"). Please read these Terms carefully. By accessing or using the Service, you agree to be bound by them.
Acceptance of Terms
By creating an account, accessing the platform, or otherwise using the Service, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to comply with these Terms and our Privacy Policy, which is incorporated herein by reference.
If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms. In that case, "you" refers to both you and the organisation.
If you do not agree to these Terms, you must immediately cease using the Service.
Description of Service
Foxhole Analytics is a web-based financial analytics platform that provides quantitative market signals, AI-assisted price analysis, sentiment scoring, technical indicators (including Bollinger band overlays), intraday trade idea generation, and portfolio tracking tools.
The Service is provided on an "as available" basis. We make reasonable efforts to maintain uptime and data accuracy, but we do not guarantee uninterrupted access or that market data will be free of errors, delays, or omissions. Market data is sourced from third-party providers and is subject to their respective terms and licensing constraints.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice, and without liability to you.
No Financial Advice
This section is the most important part of these Terms. Please read it carefully.
Foxhole Analytics is not a registered investment adviser, broker-dealer, financial planner, or any other type of licensed financial professional. The signals, forecasts, scores, and analytics generated by the platform are produced by automated models for informational and educational purposes only. They do not constitute, and must not be relied upon as, financial advice, investment recommendations, or an offer or solicitation to buy or sell any security or financial instrument.
All investing involves risk, including the risk of losing some or all of your invested capital. The value of investments can go down as well as up. Historical model performance, backtested results, and past signal accuracy are not indicative of future outcomes. Markets are inherently unpredictable and no analytical tool can guarantee profitable trades.
You should consult a qualified, licensed financial professional before making any investment decision. Your financial circumstances, risk tolerance, and investment objectives are unique to you and cannot be accounted for by any automated system.
User Obligations
As a condition of using the Service, you agree to:
- Provide accurate, current, and complete information when registering and keep your account details up to date.
- Maintain the confidentiality of your account credentials and be solely responsible for all activity that occurs under your account.
- Use the Service only for lawful purposes and in accordance with these Terms.
- Not attempt to reverse-engineer, decompile, scrape, or otherwise extract proprietary data, models, or algorithms from the platform.
- Not use the Service to transmit malware, engage in denial-of-service attacks, or otherwise interfere with platform infrastructure.
- Not share your account credentials with third parties or resell access to the Service without our written consent.
- Not use automated bots, scrapers, or scripts to access the platform in a manner that exceeds reasonable personal use.
- Comply with all applicable laws and regulations, including those related to securities trading in your jurisdiction.
We reserve the right to investigate suspected violations and to terminate accounts found to be in breach of these obligations without refund.
Intellectual Property
All content, software, algorithms, models, visual designs, trade names, and trademarks on the platform ("Foxhole IP") are owned by or licensed to Foxhole Analytics and are protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial analytical purposes, subject to these Terms. This licence does not permit you to copy, redistribute, reproduce, or create derivative works from any Foxhole IP without our prior written consent.
Any feedback, suggestions, or ideas you voluntarily submit to us regarding the Service may be used by us without restriction or compensation.
Limitation of Liability
To the maximum extent permitted by applicable law, Foxhole Analytics and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, loss of data, loss of goodwill, or financial losses arising from investment decisions — even if we have been advised of the possibility of such damages.
In no event shall our total cumulative liability to you for any claims arising from or related to the Service exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred dollars (USD $100).
Some jurisdictions do not permit the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Foxhole Analytics and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your breach of these Terms; (c) any investment decision you make based on content or signals from the platform; or (d) your violation of any applicable law or third-party rights.
